The district court awarded
the wife child and spousal support. The
husband then filed for divorce; the circuit court granted the wife's motion for
pendente lite child and spousal support under Va. Code Ann. § 20-103. Pursuant
to Va. Code Ann. § 8.01-380, the husband requested and was granted a voluntary non-suit
of the divorce action. The wife then filed for divorce; the circuit court's
divorce decree did not resolve matters of child or spousal support because they
were being resolved in the district court. The district court ultimately denied
